These terms apply to any organisation (“you”, the “Customer”) using the Proctor SDK, dashboard, or API (the “Service”). By signing in or by integrating the SDK on a customer-facing surface, you agree to be bound by these terms on behalf of your organisation.
The Service
Proctor provides browser-based proctoring software comprising a preflight wizard, a runtime SDK, a Python face-detect sidecar, and a dashboard for reviewing the resulting session data. The Service is provided “as is”; we maintain a status page at status.proctor.app and target 99.9% monthly availability for the dashboard + ingest API.
Acceptable use
You will not use the Service to surveil individuals outside the context of a fairly-administered examination, to circumvent lawful accessibility accommodations, or to process special-category data beyond what the platform is designed for (face image + biometric embedding for identity continuity). Use of the Service must comply with the data protection laws applicable to your candidates.
Fees + billing
Pricing is published on our marketing page and made specific in your order form. Usage is metered per session and per event; we bill monthly in arrears. Late payment carries interest at the statutory rate plus 2%; we may suspend the Service for invoices more than 30 days past due.
Termination
Either party may terminate for material breach not cured within 30 days' written notice. On termination we delete your data within 60 days unless required to retain it by law; you may request an earlier export.
Liability
To the maximum extent permitted by law, our aggregate liability is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim. We do not exclude liability for fraud, death, or personal injury caused by our negligence.
Governing law
These terms are governed by the laws of England + Wales. Disputes are subject to the exclusive jurisdiction of the courts of London.
